Remanufacturer’s Limited Engine Warranty

The Remanufacturer issues this non-transferable Limited Engine Warranty to the original purchaser of the remanufactured engine.  The Remanufacturer warrants the remanufactured engine purchased and which is described on this warranty, to be free from defects in workmanship or material if properly installed, used in a normal manner and properly serviced and maintained during the specified warranty periods described below.  If the remanufactured engine fails as a result of a defect in workmanship or material during the specified warranty period (measured from the time or distance from the date of purchase and described below) the remanufacturer will:

I.      For Passenger Cars and Light Trucks (under 1 ton)

a.              on a long-block for thirty-six (36) months 50,000 miles;

b.              repair, replace or refund, at the option of the Remanufacturer, the defective

            engine or part

II.      For Trucks (1 ton and above)

a.                    on a long-block for thirty-six (36) months 50,000 miles, whichever occurs first;

b.                    repair, replace or refund, at the option of the Remanufacturer, the defective engine or part

III.      For Taxis, Fleet, Marine, Commercial Industrial and Off-Highway Use

a.                    on a long-block for (3) months; or 3,000 miles whichever comes first;

b.                    repair, replace or refund, at the option of the Remanufacturer, the defective engine or part

Where and How Will The Warranty Be Honored?

In order for the warranty to be valid, the engine and/or part must be returned at your cost within the specified warranty period to the Remanufacturer’s address above, along with this original warranty and the sales receipt, provided that:

1.                    Prior written authorization must be obtained from the Remanufacturer before any warranty work may be performed, and

2.                 Repair bills and proof of payment must be submitted prior to reimbursement by the Remanufacturer.

3.                    Maximum labor credit on repairs/installations are limited to $400.00.

4.                    The remanufacturer’s warranty is limited to a maximum of $400.00 in repair/installation labor credit for 90 days from date of purchase. Thereafter no labor allowance is allowed.

5.                    Should the remanufacturer determine to replace the failed engine with a replacement engine, such replacement engine would the fulfill the limited warranty, hereunder, terminated any and all future warranty claims at that time.

Disclaimer and exclusions To Coverage Applicable To Limited Engine Warranty

This Limited Warranty Does Not Apply If Engine Is:

1.                    Installed in vehicles used for racing or contains high performance

modifications.

2.                    Modified, altered, abused, unreasonably used, improperly installed; damaged by accident, fire, negligence, misuse, overheating, detonation, or lack of lubrication; or incorrect application, or incorrect or defective units or accessory equipment attached to the engine which were not authorized by the original manufacturer; or installed in a application for which it was not ordinarily intended.

3.                    Not properly serviced, maintained or fueled in accordance with the original manufacturer’s specifications.

This Limited Warranty Excludes:

1.                    Transportation expenses of a defective engine or part to or from the Remanufacturer’s address above.

2.        Compensation for inconvenience or loss of use.

3.        The cost of a rental car, lodging, reimbursement for time off work, loss of income,

4.                    commercial loss, towing charges, telephone calls, legal fees and costs, oil, filters, anti-freeze, fluids or other consequential damages.

5.                    Repairs otherwise covered if performed without prior written authorization from the Remanufacturer and without submission of a repair bill and proof of payment.

6.                    The cost of all parts replaced under this warranty unless the parts have been supplied by the Remanufacturer or specifically authorized for local purchase.  All replaced parts must be submitted (prepaid) to the Remanufacturer for inspection before labor or incidental costs will be considered.

LIABILITY UNDER THIS WARRANTY IS LIMITED TO THE RETAIL PRICE OF THE DEFECTIVE ENGINE OR PART AT THE TIME OF PURCHASE OF THE ENGINE, AND THE REMANUFACTURER SHALL HAVE NO LIABILITY WHATSOEVER FOR ANY CONSQUENTIAL OR SPECIAL DAMANGES.  THIS LIMITED WARRANTY IS THE ONLY EXPRESS WARRANTY MADE BY THE REMANUFACTURER WITH REGARD TO SUCH ENGINE.  THE DURATION OF ANY WARRANTY IMPLIED BY LAW, INCLUDING THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR PARTICULAR PURPOSE, IS LIMITED TO THE DURATION OF THE EXPRESS WARRANTY.  THE FOREGOING WARRANTIES ARE EXCLUSIVE AND IN LIEU OF ALL OTHER REMEDIES.  SOME STATES DO NOT ALLOW LIMITATION ON HOW LONG AN IMPLIED WARRANTY LASTS NOR THE EXCLUSIONS OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMANGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.

This Warranty Gives You Specific Legal Rights, and You May Also Have Other Rights Which Vary From State to State.
